What is Updated Return (ITR-U)?

Updated Return (ITR-U) is a return that enables a taxpayer to update the income and tax data after the original or belated or revised return period based on the provisions laid down in the Income-tax Act, 2025.

Relevant Law for Tax Year 2026-27

For the Tax Year 2026-27, the relevant law is Income-tax Act, 2025, which has been enacted and is applicable from 1 April 2026.

Section for Updated Return

In the Income-tax Act, 2025, Updated Return falls under Section 263(6), whereas in the old Income-tax Act, 1961, it was under Section 139(8A).

When Should ITR-U be Filed?

Updated Return may be filed to:

  • Declare the income not declared previously.
  • Rectify any omission or mistake made.
  • Pay additional tax if needed.
  • Update the information filed previously in a return.

Is There Any Condition for Filing ITR-U without Filing an Earlier Return?

Yes. An Updated Return can, under certain statutory conditions, be filed even if the taxpayer has not filed any return before.

However, it can also be filed after filing the original or belated or revised return.

Important Note

ITR-U should not be mistaken as a Revised Return.

Revised Return is usually filed for correction of the earlier filed return within the statutory period.

But an Updated Return is different from Revised Return.

It is an independent compliance method applicable after the relevant opportunities of filing returns.

Additional Tax

Updated Return filing usually involves payment of additional tax, along with the tax and interest due.

The additional tax rate applicable varies depending upon the filing date of ITR-U.

Who Can File ITR-U?

An Updated Return may be filed by following types of taxpayers, among others:

  • Individual
  • HUF
  • Firm
  • LLP
  • Company
  • AOP
  • BOI
  • Other eligible individuals

It is advisable to confirm eligibility and restrictions as per relevant provisions.

Important Limitations

An ITR-U cannot be filed for any kind of correction arbitrarily. There are specific cases in which an Updated Return cannot be filed as per the provisions of the Income-tax Act, 2025.

Consequently, while filing ITR-U, it is advisable to ascertain:

Eligibility → Income → Tax Liability → Interest → Additional Tax → Statutory Requirements

ITR-U and Loss

The law has been amended to allow ITR-U for certain cases involving reduction of loss. Applicability needs to be checked for specific tax year and cases.

Can ITR-U Be Filed Again?

An ITR-U is not meant to offer any unlimited scope for correction of returns. The individual must ensure that his/her income and taxes are reported correctly before filing ITR-U.

Simple Illustration

Illustration 1 – Incomes Not Disclosed

A taxpayer has made the filing of the return but realizes subsequently that certain interest income is not included.

The taxpayer may opt for filing the Updated Return, depending on the conditions of tax, interest, and additional tax, if any.

Example 2 – Return Not Filed

A taxpayer failed to file his original return during the stipulated period.

Depending upon the eligibility and other statutory conditions, the taxpayer may use the Updated Return process to report the income and pay tax.
